UK Residency Rule Change Worries Many Kenyans as Permanent Settlement Wait Could Double
Many Kenyans living and working in the United Kingdom may face a longer wait before qualifying for permanent residency following the government's announcement of a new immigration settlement framework.
On 2 November 2026, the UK Home Secretary, Shabana Mahmood, presented the government's Earned Settlement policy to Parliament. The proposal changes how migrants qualify for Indefinite Leave to Remain (ILR), which allows eligible people to live and work in the UK permanently without time restrictions.
Under the proposed framework, the standard qualifying period for settlement will increase from five years to ten years. However, some groups will retain shorter routes depending on their earnings, occupation and contribution to British society.
According to the UK Home Office, people earning more than £50,000 annually and certain public service professionals, including doctors, nurses and teachers, may qualify after five years. The highest earners, receiving more than £125,000 annually, could qualify after three years.
Eligible care workers who earned at least £25,000 annually and complied with their visa conditions will also retain a five-year settlement route.
The proposed reforms introduce additional conditions for applicants. These include maintaining a clean criminal record, demonstrating a high standard of English, having no outstanding government debts and showing sustained National Insurance contributions.
For Kenyan migrants, the changes could affect workers, professionals and families who have been planning their future around the previous five-year settlement route.
However, the government has indicated that certain transitional protections will apply to some existing migrants, including qualifying care workers and public service employees.
The announcement has attracted attention among Kenyan communities because many people have moved to Britain for employment, education and better economic opportunities.
The government says the new framework is intended to reward migrants who contribute positively to the country and comply with immigration requirements.
Although the announcement provides a clearer direction for the proposed reforms, the detailed implementation arrangements still need to be established. Migrants should therefore avoid making decisions based solely on social media reports.
Kenyans living in the UK are encouraged to check official immigration updates and seek qualified immigration advice before making decisions about their settlement applications.
